Booking agreement
La Vida Lagom (hereinafter “LVL”, “we”, “us”, “our”, “host”, “organizer”) is a sole trader company run by Amy Jaggers from her home address of 28 Scotter Road, Bishopstoke, Eastleigh, SO50 6AJ, UK.
LVL’s mission is to support the wellbeing of professional women (hereinafter “you”, “guest”, “traveler”, “attendee”, “participant”) by providing opportunity to ‘retreat’ from daily life and to engage in holistic wellbeing activities such as meditation and mindfulness which aids the ability to live a more resilient, balanced and contented life.
Contract
Before making a booking with LVL which involves an exchange of money between us and you, you must ensure that you have read and understood these terms and conditions (raising any questions you have with us prior to making payment). Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By completing registration and asking us to confirm your booking, you are accepting all of the terms and conditions laid out below and acknowledging that you have read the terms of this contract and agree to it. If you do not agree to these terms and conditions or any other aspect of our Agreement, then you must not make a booking or engage in any travel or retreat with us.
If you are making a booking as a group or on behalf of another person, you are responsible for sharing these terms and conditions with all members of the group/the guests attending and you are financially responsible for the booking. We will not be liable for your failure to share these terms with all guests/attendees.
You represent and warrant that you are (a) over the age of eighteen (18); (b) legally authorised to act on behalf of those you represent and accept these terms and conditions on their behalf and (c) the information supplied by you is true and correct.
Violations by you
You agree that any violations of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase and (c) you being denied access to the applicable travel or service.
Changes to these terms and conditions
LVL reserves the right, in our sole discretion, to change these terms and conditions at any time. Updated versions of the terms and conditions will be posted on our website at www.lavidalagom.com and are effective immediately on posting. If we make material changes, we will notify you. Please check frequently, especially before you make a booking, to see if these terms and conditions have changed. Your continued use of our services, including continuing to maintain any bookings after any changes to the terms and conditions constitutes your consent to the changes.
Booking/Payment
When you are ready to participate in your next retreat or wellbeing event, simply complete the registration details associated with the relevant retreat / event which can be found on our website here.
Your booking will be confirmed on receipt of the completed registration form and following an introductory call, text or email, you will be provided with a payment link to provide a non refundable deposit, or if you so chose, payment in full.
After booking you will receive confirmation of receipt and any remaining balance due. Remaining balance due date will be specified in the booking registration form. Remaining balance can be paid in full prior to the due date or in installments by agreement. This will also be confirmed in writing.
You must make all payments in full and on time. Failure to make a payment may result in the cancellation of you retreat / event booking. In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect.
Our bookings do not include travel costs and/or airfare. You must make independent travel arrangements related to your booking. Any contract for airfare is with the carrier and is subject to its terms and conditions. We will not be liable for any changes fees or cancellation fees or other additional costs you incur with the air carrier.
Once payment in full for your retreat/event is processed, you will receive i) a receipt and ii) a checklist of items for you to review. Please review documents carefully and promptly as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible with any amendments or corrections.
Price and rate changes
The price of your retreat / event will be based on known costs at the time of issue. All prices we advertise are accurate at the date published, but we reserve the right to change those prices, or add a supplement cost as necessary in specific circumstances, such as changes by our suppliers, dues or taxes payable locally, currency fluctuations and government action(s). If these result in an increased cost to supply your retreat / event, we reserve the right to increase the price and will communicate this in writing with clear additional payment(s) required reflecting any changes made.
We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed. We will advise you of any errors of which we are aware of and the then applicable price at the time of booking.
What is included in your retreat / event
Accommodation
If applicable to your specific retreat/event, over night accommodation is provided as detailed in your specific booking registration form. Special requests such as accessible room, single occupancy rooms etc. must be made at time of booking. Every effort will be made to accommodate your requests, although depending on the venue type, and specific request, this can not be guaranteed.
There may be additional charges for such requests which will be solely the expenses of the guest making the request. Guests should be aware that accommodation sizes, standards and facilities can vary regionally. This can include a difference in bed sizes, room sizes, room amenities and bathrooms. LVL reserves the right, if necessary, to substitute published accommodations for other similar accommodations. For example, we can not be held responsible for hotel over bookings and should such occur, we will undertake to find similar accommodations. Such substitutions may be made at any time and without prior notice.
Such substitutions are at LVL’s discretion and no refunds will be offered for changes in accommodations. While we exercise due diligence in the selection of our venues and partners, hotel and other accommodation profiles are based on information provided to us by the supplier. This includes images and descriptions of the venues, properties and rooms. Whilst LVL does its best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities or images.
Meals
Meals are indicated on the specific pages of the retreat/event which can be found here. Dietary requirements should be requested via the booking form or supplementary information form which (event dependent) will be provided to guests after booking.
For safety and liability reasons, LVL can not be responsible for directly accommodating any food allergies, dietary requirements or restrictions, and we are not responsible for any issues or problems associated with the same. We will advise the caterers of your requirements and will do our best to cater for your requirements, but depending on the venue and catering supplier this can not be guaranteed.
Changes to the itinerary
Changes to the itinerary are not anticipated; however, La Vida Lagom (“organiser”) reserves the right to make any changes we determine necessary, with or without advanced notice. LVL reserves the right to make changes to any published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will make all reasonable efforts to arrange a comparable alternative, but this cannot always be guaranteed. While no changes are anticipated, there may be occasions when certain alterations become necessary. These can include but are not limited to the following reasons: religious holidays, national celebrations or unforeseen events such as weather, pandemic, governmental closures, acts of God, or any other reason – these are provided as examples only. LVL reserves the right to change the itinerary due to such unforeseen events or emergencies. If we, or our suppliers, suggest alternative activities in place of a planned activity or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damages will be against the supplier of the alternative activity.
What is not included in your retreat / event
Any items and matters that are not referred to in your itinerary and are not included in the retreat price. This can include, but is not limited to, travel costs, airfare, baggage, passports and visa fees, trip protection and / or insurances of all kinds, gratuities, additional spa/holistic wellbeing treatments, laundry, beverages and meals not included in the retreat/event cost, optional expenses and all items of a personal nature. Additional taxes and surcharges may be collected by non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the retreat whether of your own volition, our decision based on behaviour that disrupts the retreat/event and impacts the group, due to illness, action by any government or other reason.
Non-operation of retreats / events
All retreats/events are based on a minimum number of participants. LVL makes every effort to ensure that retreats/events meet the minimum participant requirements. However, if the retreat does not make these numbers or drops below due to cancellations, cancellation of the retreat / event may occur at the sole discretion of LVL. In such cases, guests will be advised at least 30 days prior to departure (for residential retreats) and at least 5 days prior to a single day event. LVL reserves the right to change the departure date. We may offer alternative dates. You may chose to accept the alternative dates or cancel your booking, in which case a full refund will be provided. Any airfare changes or cancellations fees will be in accordance with the terms of the carrier and LVL will not be liable for any additional costs incurred outside of the retreat prices such as visa and passport fees, travel insurance or any other purchases made in anticipation of the retreat / event.
Changes and cancellations
Changes by guest
Since changes are considered cancelled services, additional cancellation penalties may apply. Changes may be subject to additional hotel or venue charges based on availability and therefore may incur additional fees. Changes to airfares are subject to the carrier’s terms and conditions.
Cancellation by guest
Refunds or transfers (to another guest or another date) may be provided by LVL under certain limited circumstances only. Therefore LVL strongly recommends that all guests purchase a “cancel for any reason” travel insurance policy on paying the non-refundable deposit. Should cancellation become necessary, all requests for cancellations must be submitted in writing to Amy Jaggers (Amyj@Lavidalagom.com) in line with the deadlines listed below. Regardless of the reason, cancellations result in additional costs and processing requirements for the organiser and as such all cancellations will be subject to a cancellation fee.
In the event of cancellation:
For retreats of more than 1 day:
– 90 days or more prior to retreat: any payments made will be refunded, less £200 deposit.
– Between 90 days and 30 days prior to the retreat: half the cost of the retreat will be required. If the balance has already been paid, a refund of half the retreat cost (less deposit) will be made
– 30 days or less prior to the retreat: the full cost of the retreat will be required. If the balance has already been paid no refund will be provided
There is no refund for unused arrangements. As LVL prices are based on contract rates, there will not be any refund for any unused portion of a retreat / event booking. If you cancel whilst the trip is in progress, there is no refund for the unused portion.
Cancellations or changes by the host
We reserve the right to cancel or reschedule any departure for any reason. If we cancel, except in the case of a force majeure event, we will offer alternative arrangements. We may, at our sole discretion, offer a transfer or refund with the cancellation schedule above. Guests are responsible for any additional costs for airfares or other travel arrangements not made by us.
LVL assumes no liability for any loss, damage, delay or cancellation resulting in whole or in part from an act of God or any other force majeure condition, including without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms, riots or civil war, commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labour disruptions, restraint of rulers or people, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorisation, damages to its facilities or the travel supplier and its facilities, or any other unforeseen by LVL that impacts negatively on or hampers its ability to fulfill any of its contractual conditions. In circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by LVL.
Travel Protection
Travel protection coverage is not included. It is the traveler’s (your) responsibility to protect your purchases. For this reason, travel insurance and additional ‘cancel for any reason’ insurance is strongly recommended. Such insurance should include trip cancellation or interruption, medical expenses, emergency evacuation/repatriation and baggage. Travel protection insurance plans can help protect you in the event of loss of non-refundable retreat/trip/event deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before the retreat/trip/event). It also helps with reimbursement for medical emergency costs (including potentially costly medical evacuation costs), missed connections and baggage loss.
LVL is not qualified to answer questions regarding travel protection and insurance policies, the benefits, exclusions and conditions of plans. LVL can not evaluate the adequacy of any protection policy. If you have questions regarding travel protection and insurance please speak to an insurance broker or agent.
If you chose to travel without adequate cover, LVL will not be liable for any of your losses however arising.
Destinations
Travel to certain destinations may involve greater risk than others. LVL urges travelers to remain informed of travel requirements and restrictions. It is your responsibility to be aware of all travel requirements to a specific destination including entry visas, inoculations and risk.
Assumption of risk/waiver
Some travel may involve inherent risks. Inherent risks include, but are not limited to: risk of injury or death from motor vehicle collisions; animals, including attack or encounter with insects, reptiles or other animals; exercise and physical exertion; roadway hazards; slips, trips and falls; criminal or terrorist acts; government actions; consumption of alcoholic beverages or tainted food; consumption of non-potable water (non drinking water); exposure to the elements including heat, cold, sun, fire, water and wind; your own negligence and/or the negligence of others, including tour guides and other travelers; accident or illness occurring in remote places where there are no available medical services; fatigue; chill, overheating or dizziness; known or unknown existing medical conditions; the negligence or lack of medical training of third parties who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.
You (the traveler) understand that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness or death. In order to participate of the enjoyment and excitement of any trip/event/excursion, you are willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness and death.
You hereby accept and assume full responsibility for any and all risks and agree to fully release LVL for any and all risks and agree to hold harmless and full release LVL from any and all claims associated with the travel/trip/excursion/event, including any claims of third-party negligence and/or the negligence of another LVL traveler, and hereby covenant not to sue LVL for any such claims or join any lawsuit or action that is suing LVL. This agreement also binds your heirs, legal representatives and assigns. Ther terms of this hold harmless and release of all liability paragraph shall survive any termination or cancellation of this contract whether by operation of law or otherwise.
Indemnification
You (the traveler) agrees to and shall indemnify and hold harmless LVL from any expenses, losses, liabilities, damages, judgements, settlements and costs (collectively ‘damages’) involved with or incurred by LVL (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation of this agreement and (ii) any damage caused by you (the traveler) whilst participating in the trip/event/excursion.
Pre-existing medical conditions/persons with disabilities
Whilst LVL aims to host inclusive retreats and events, the nature of destinations traveled to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss your participation in any event/retreat/trip.
It is essential that you notify LVL before paying the deposit if you have any disability or pre-existing medical condition which may impact your ability to participate in activities, or requires adjustments and accommodations to be made, so that we can assist you in considering the suitability of the arrangements and/or in making the booking.
LVL will communicate any adjustments and requests to suppliers but cannot be responsible if alternative accommodations are not available. Any accommodations provided which incur additional cost will be at the sole expenses of the traveler requiring the accommodation.
Our suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be arranged with and provided by whoever you are traveling with. We may also request that you provide a letter from your medical practitioner confirming your fitness to travel.
For the safety of guests LVL reserves the right to request health information prior to travel and to exclude any participants we deem unfit for travel at its sole discretion.
If you are pregnant or expecting at or around the time of planned travel please inform us prior to booking. Some suppliers will not permit travel past certain gestational periods for your safety and the the safety or your child/children. If you become pregnant after booking with us, please consult a medical practitioner and review the terms and conditions for any travel supplier as they relate to your booking to determine whether you will be permitted or prevented from travelling. If you are denied boarding embarkation or access to a supplier due to pregnancy, LVL shall not be liable for any losses, expenses or refunds resulting from such loss in access for you or anyone in your group.
Although LVL provides its services with your health and wellbeing in mind, we are not a healthcare, mental health or medical practitioner. Therefore it is critical that you consult your personal medical practitioner for necessary medical or appropriate care, and obtain appropriate authorisation before participating in any retreat/event activities if you have any cause for concern, are prone to injuries, are pregnant or nursing or have any other specific medical conditions.
All LVL services, including coaching and holistic wellbeing treatments are provided for informational purposes only and are not intended to diagnose any medical, mental health or other healthcare conditions and nor does it replace the advice of licensed medical professionals, or provide any medical advice, opinion, diagnosis, treatment or guarantee.
Photographic/Video Likeness
You hereby give consent and irrevocably grants to LVL a perpetual license to publish any photographs, videos and/or other media of the retreat/event guest (or guest’s likeness) in printed or electronic media without obtaining further consent and without compensation. Each guest releases LVL and its representatives from any liability in connection with any use of such photographs, videos and/or other media
Your behaviour
For the benefit of everyone on the retreat, LVL reserves the right to accept or reject any retreat participant at any time without liability, and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the retreat, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant from the retreat.
Please keep in mind that alcohol consumption may be allowed on retreats / events, however we request that you keep it to a minimum. A glass or two of wine is fine with dinner; any excess alcohol consumption can constitute a reason for dismissal on the retreat (without refund, as stated in your Terms and Conditions).
LVL may, at its sole discretion, require any guest to leave the retreat/event if it is reasonably believed that you have engaged in is engaged in or is threatening to engage in behaviour that may adversely affect the safety. security, comfort, enjoyment or wellbeing of other retreat/event guests, LVL representatives or suppliers, including but not limited to, behaviour that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory or obscene; or has failed or refused, or is failing or refusing, to follow LVL’s rules and procedures.
